Subject: New York City Environmental Control Board Violations ("ECB") Penalty Relief ProgramCounties

 

New York City has instituted an amnesty program for ECB violations under a "NYC Penalty Relief Program".   

 

The base fine for an ECB violation can be paid without also paying interest, a penalty or a late fee, provided that the condition, which caused the fine, was cured.

 

The Program applies to violations "in default" for which a hearing was scheduled before May 1, 2009.   The program may be very helpful in those cases where a title company or attorney, is holding an escrow.  This will give the party an opportunity to remove the violation at a discounted amount.

 

An application must be filed before December 21, 2009.
